As part of his job, appellant was required to check the station and to fill the tanks on a regular basis. It was not unusual for him to work for several days at the station in a row without a break and without refreshments. In the course of his duties, appellant was required to stop at a service station located about three-quarters of a mile from the filling station and purchase cigarettes. Each day he purchased cigarettes in five or six packs. After he returned to work at the filling station, he removed the packs from the cooler and placed them on a shelf in the cooler, or, when he was required to do so, he placed them on the shelves where food and other items were kept. He was never given permission by his foreman to take the cigarettes from the cooler to his own car and was never told that he could not smoke while working.
